(hereinafter referred to as “Lusiskin LDA” or “the Company”)
2. Purpose
These Terms and Conditions of Sale and Use (hereinafter the “Terms”) govern access to and use of the website LUSIPURE.eu (hereinafter “the Site”), as well as the sale of cosmetic products (hereinafter “the Products”) offered by Lusiskin LDA.
Placing an order on the Site constitutes full and complete acceptance of these Terms.
3. Products
The Products offered are cosmetics compliant with European Regulation (EC) No. 1223/2009.
Photographs and descriptions are provided for reference only; while accurate, they are not contractually binding.
As the Site owner, Lusiskin LDA may restrict access to the Site at any time, including for maintenance or repair purposes. It also reserves the right to close the Site if deemed necessary.
4. Prices and Payment
The sale price of the Products is determined by Lusiskin LDA. Prices are indicated in euros, including all taxes, but excluding delivery costs. Shipping costs are added before final validation of the order for deliveries within Portugal and the European Union.
For other countries, prices do not include applicable taxes, customs duties, or other additional fees.
The customer is responsible for any taxes or duties applicable in the country of import.
Payments are made through online payment platforms contracted by Lusiskin LDA. The terms of these platforms apply to the transaction, and they are responsible for transferring the corresponding amount to Lusiskin LDA.
5. Orders
The customer selects the desired Products, adds them to the shopping cart, and confirms the order after verification.
An order is considered final only after email confirmation and full payment.
Lusiskin LDA reserves the right to refuse any order in case of prior dispute or payment anomaly.
If multiple customers place orders for the same product simultaneously, the sale will be granted to the first buyer to complete and pay for the order. Other orders will be canceled.
6. Delivery
Products are delivered according to the conditions specified when the order is placed.
Delivery times are estimates and may vary depending on the destination.
In case of delay or loss, the customer must contact customer service at the provided address.
If the customer fails to collect the parcel within the carrier’s time limits or refuses delivery, shipping and return costs will be deducted from the refund. The refund will only be processed once the parcel has returned to our warehouse.
7. Right of Withdrawal and Returns
In accordance with applicable law, the customer has 14 days from receipt of the order to exercise the right of withdrawal, without justification.
The customer must first contact the company by email at return@lusipure.eu, indicating the order number.
Products must be returned unopened, unused, and in their original sealed packaging.
Return shipping costs are borne by the customer, except in cases of error in preparation or defective product attributable to Lusiskin LDA. In the case of a return, an email must be sent within 48 hours after receipt of the package to return@lusipure.eu.
The Company processes exchanges, returns, or refunds only for Products purchased on its online store.
8. Consumer Dispute Resolution
In accordance with Portuguese Law No. 144/2015, customers considered consumers have the right to resort to Alternative Dispute Resolution (ADR) entities in the event of disputes arising from purchase or service contracts, without prejudice to judicial recourse.
The updated list of Alternative Dispute Resolution entities is available on the Consumer Portal: www.consumidor.pt.
For online purchases, consumers may also use the European Online Dispute Resolution (ODR) Platform: https://ec.europa.eu/consumers/odr.
9. Warranties and Liability
All cosmetic products sold on the Site comply with applicable regulations and have undergone a safety assessment before being placed on the market.
Lusiskin LDA shall not be held liable for the following:
• Misuse or non-compliant use of the Products.
• Damage resulting from inappropriate use.
• Minor variations between product photos and the item received.
10. Personal Data
Personal data collected are processed in accordance with the General Data Protection Regulation (GDPR) and are necessary for managing orders, deliveries, and customer service.
11. Intellectual Property
All content on the Site (texts, images, logos, graphics, videos, trademarks) is protected by intellectual property law and remains the exclusive property of the Company.
Any reproduction, distribution, or unauthorized use is strictly prohibited.
12. Governing Law and Jurisdiction
These Terms are governed by Portuguese law.
In the event of a dispute, and after an attempt at amicable resolution, the competent courts will be those of the jurisdiction where the Company’s registered office is located, unless otherwise required by mandatory law.
